Modes of Dispute Resolution

You Have Options Beyond the Courtroom

Whether you are in the middle of a divorce, neck-deep in a business dissolution, involved in a dispute with a shareholder/partner or employee, or having an estate or probate issue, it doesn’t have to be contentious and ugly.

By choosing to resolve your matter outside of court through one of the Alternative Dispute Resolution (ADR) methods below, I can help you save time and money as well as reduce the inevitable stress these situations create.

Litigation and Kitchen Table

Working in a neutral capacity, I provide an objective view of the financial impact of your dispute and its potential outcomes, facilitating open discourse between all involved parties. You may not always like what I have to report, but you can rest assured that it is accurate and honest, giving you valuable insight to help you make the right decision.

Collaborative

Experienced in collaborative divorce (for marital dissolutions) and civil collaborative practice (for business and estate/probate disputes), I’ve helped hundreds of clients as a neutral financial professional in an educator capacity working with opposing parties to find a mutually agreeable resolution that reflects their goals and interests. Together with other carefully selected collaborative team professionals, we can create a legally and financially-sound plan predicated on respect, cooperation and fairness, with prospects for greater long term success. To ensure my collaborative work is without bias towards solutions that may generate future work for me, and to afford the opportunity to reassemble the collaborative team if an issue arises down the road, I do not work with any party once their collaborative matter is resolved.

Arbitration

As with mediation, I objectively review all the facts and figures presented by all parties. Following a discussion of the relevant information, I work with other ADR professionals to present my findings and recommend an award. Depending on the type of arbitration you wish to pursue (non-binding, binding or final offer, aka “baseball” arbitration) these decisions can be legally binding.
